Literacy Volunteers Valley Shore (LVVS) complies with the Americans with Disabilities
Act (ADA) and with all federal and state laws pertaining to disabled persons. The terms
“disability” or “disabled” as used in this policy statement shall be construed in a manner
consistent with the ADA and other pertinent
federal and state laws.
Policy Implementation
Provision of Services
LVVS will make reasonable modifications in policies, practices, or procedures to accommodate a person with a
disability unless such modifications would fundamentally alter the nature of the services provided by LVVS.
Reasonable accommodations include conducting tutoring in a physically accessible public site or providing
large print materials.
LVVS volunteers will furnish auxiliary aids when necessary to ensure effective communication unless an
undue burden would result.
LVVS need not offer or continue to offer services to an individual who poses a direct threat to the
health and safety of others.
Intake Procedure
An interviewer may not ask whether an applicant has a disability. Interviewers should inform
applicants that LVVS’s policies and practices can be modified, if necessary, for the applicant
to participate in the program.
If an applicant voluntarily discloses that the applicant has a disability, an interviewer may
ask if the applicant has documentation that would assist LVVS in designing an instructional plan
for the individual. The applicant can be asked to share the information voluntarily but cannot be
required to provide such documentation.
The same eligibility requirements apply to disable and non-disabled applicants for services at LVVS.
